Military Divorce Question?

I posted this under marriage/divorce and got one really great answer, looking for any more advice/info you all can give.

My good friend has sadly been blinded by love until recently. Her husband is a marine and is worth jack ****. It is a long story but in essence, he cheats on her, parties, spends money,never signed her up for ANY benefits- she doesn’t have an military ID and he is basically using her for marriage and seperation pay. I mean, even his mom told her to leave him. He is out of the military in August. What can be done here? Would reporting it to his CO do anything? How long would the process of divorce take (Orange County, CA)? He has openly said he won’t give her a divorce, I guarantee that is so he doesn’t lose his pay. Any advice would be much appreciated. Thanks!

The military can not force a divorce nor can the CO force a soldier to spend their money in a specific way. Only counsel the member unless a crime has been committed and adjudicated by the UCMJ.

Alimony is only awarded by a court, and is defendant on the circumstances surrounding the marriage and NOT the actions of the individual members.

1. How long was the marriage?
2. Did the spouse claiming alimony give up a career to watch children?
3. Disabilities, etc.

She should just file for a divorce with an attorney.
